NRDC has a new twist on an old idea: use the Clean Air Act to address climate change. The venerable environmental-law group wants EPA to make the states establish statewide performance standards requiring electricity providers to steadily lower their emissions of carbon dioxide per kilowatt-hour produced. “Closing the Power Plant Carbon Pollution Loophole” is the name of NRDC’s initiative, and it’s backed by a 90-page report replete with elaborate modeling and head-spinning fine print.
The council calls its proposal “groundbreaking,” and two of the green movement’s heavy hitters agree. “Obama can tackle climate in his second term, and he doesn’t need Congress to do it,” enthused David Roberts at Grist:
It is still possible for Barack Obama to secure an honorable climate legacy. He can dramatically reduce U.S. carbon emissions in his second term. And he can do it without help from Congress. He doesn’t even need a crafty new plan — the Natural Resources Defense Council has come up with one for him, based on a provision in the Clean Air Act. All he needs is political courage.
Roberts wrote that last week. On Tuesday, former Obama “green jobs” guru (and NRDC board member) Van Jones raved that the initiative “would make a tremendous difference.”
But would it? The answer may depend on the definition of “tremendous.”
Based on the report (see its page 4 graph), NRDC’s proposal would result in a nearly 650 million metric tons/year drop in U.S. power-sector CO2 emissions by 2025, from a 2011 baseline. NRDC calls that a 26% reduction in 2011 U.S. electricity-sector emissions, and it appears to be a 12% drop in 2011 CO2 emissions from all U.S. sources.
By bundling the projected decrease with anticipated reductions from automobiles due to stiffer CAFÉ standards, along with ongoing displacement of high-carbon coal by fracked gas, the council figures that the U.S. can meet the old Waxman-Markey goal of trimming 2020 emissions by 17% below the 2005 level. If that’s a “tremendous difference,” then Obama’s 4-point popular vote margin over Romney was a landslide.
A contrary perspective comes, unsurprisingly, from the Heritage Foundation, a leader of the climate-denialist camp. But Heritage may be on to something. As the right-wing think tank’s climate policy point man David Kreutzer pointed out last week, the entire hoped-for drop in U.S. emissions to 2025 is less than the 720 million metric ton increase in China’s CO2 emissions in 2011. Kreutzer acidly noted, “[T]he NRDC goal for 12 years worth of reductions in the U.S. will be more than offset with one year’s worth of increases in one developing country.”
To be sure, anti-climate diehards like Heritage obsessively flog China’s monstrous growth in CO2 emissions to justify U.S. stasis. But Kreutzer’s point can’t be dismissed just on account of the source. The downward bend in U.S. emissions via the NRDC initiative is indeed dwarfed by China’s business-as-usual trajectory. That might be tolerable if NRDC’s bright idea could serve as a template to put China on a carbon-busting course. But that’s improbable at best.
The NRDC proposal is painstakingly tailored to accommodate the marked differences in emission rates between coal-dependent and independent states. It’s also fiendishly complex, with intricate provisions for crediting utility uptake of renewables and efficiency. From a legal standpoint, predicts Clean Air Act expert Nate Richardson of Resources for the Future, “If [EPA] adopts NRDC’s proposal … that battle will be tough.” All in all, it’s hard to imagine other nations following the NRDC path.
Contrast that path to a U.S. carbon tax. As we’ve pointed out for years, most recently in this week’s U.S. News Debate Club, the border tax adjustments in a U.S. carbon tax would incentivize China and our other trading partners to impose their own carbon taxes so that carbon tax revenues flow to them, not the U.S. Treasury. Even a “starter” tax, like an $18/ton ($20/metric ton) levy that would raise enough revenue to extend the expiring payroll tax holiday, might well jumpstart carbon pollution pricing on a global scale.
That would be groundbreaking indeed.

On Carbon Taxes and Emissions: Seeing Through the Fog from the Breakthrough Institute
In recent years the Bay Area-based Breakthrough Institute (BI) has staked out a place in the climate and energy debate by arguing that the way to decarbonize U.S. and world energy is to spur technological innovation — not through the “stick” of carbon taxing but by the “force multiplier” of federal R&D. BI’s current poster child for this approach is hydraulic fracturing (fracking), although the Institute also backs wind and nuclear power and photovoltaic solar cells.
BI’s latest salvo, a report released a few days after the elections, made sweeping claims for the superiority of fracking over pricing carbon emissions:
Over the last four years, emissions in the United States declined more than in any other country in the world. Coal plants and coal mines are being shuttered. That’s not from increased use of solar panels and wind turbines, as laudable as those technologies are. Rather it’s due, in large measure, to the technological revolution allowing for the cheap extraction of natural gas from shale. By contrast, Europe, with its cap and trade program, and price on carbon, is returning to coal-burning.
BI president Michael Shellenberger and board chair Ted Nordhaus sounded the same theme in this letter in the New York Times on Nov. 15:
Germany and other European countries have put a price on carbon, through their cap-and-trade system, but are returning to coal burning anyway. A carbon tax can play a useful role as a way to raise money for public investments in innovation, but the suggestion that a carbon tax would result in the kind of innovation that is allowing natural gas to replace coal is to ignore the real-world evidence.
A lot of assertions and assumptions are packed into those two passages. Here are the key ones:
- U.S. greenhouse gas emissions have fallen considerably since 2007 or 2008.
- Solar and wind had little or nothing to do with that drop.
- No country cut greenhouse gas emissions more since 2007 or 2008 than the U.S.
- Europe has a price on carbon.
- Europe is returning to coal-burning.
- A carbon tax won’t contribute to low-carbon innovation.
Assertion #1 isn’t in dispute — we all know that the fracking boom has enabled relatively low-carbon methane gas to make big inroads into coal’s share of U.S. electric power generation. And #6 is more a question of belief — and how high a carbon tax is assumed — than of empirical validation. But assertions #2, #3 and #5 are eminently quantifiable, and so, as we’ll see below, is #4. I wrote to Shellenberger and pressed him on these points. His replies were collegial, but at variance with empirical data.
Breakthrough Claim #2: Solar and wind contributed little or nothing to the drop in U.S. GHG emissions over the last four years.
Or, in BI’s own words: “Coal plants and coal mines are being shuttered. That’s not from increased use of solar panels and wind turbines.”
Hardly. Verification of wind power’s strong contribution to displacing coal can be seen in the table comparing U.S. electricity generation in 2011 and 2007. Electricity from coal-fired power plants, the single largest source of U.S. CO2 emissions as well as the mainstay of our power supply, fell by 282 TWh, a decrease equivalent to nearly 7% of all U.S. electricity production in either year. (A terawatt-hour is a billion kWh.) Because total U.S. electricity use in 2011 was little changed from 2007, the drop in coal-fired power had to be made up by ― indeed, was caused by ― increases in other sources. As the table shows, gas-fired generation was the largest source of increased electric output, growing by 120 TWh. But wind was a strong second. Its gain of 85 TWh over the same period was 70% as great as the gain from natural gas. (Hydro also grew substantially, but its increase was an artifact of weather variability in the form of deeper snowpack. Note also that solar-generated electricity is relatively tiny.)
To be sure, full-year 2012 data will almost certainly show a further big dip in coal-fired electricity, with the lion’s share of that one-year change (2011 to 2012) attributable to increased use of natural gas. Yet wind’s contribution to the ongoing drop in coal-fired electricity also increased in 2012, albeit by considerably less than the contribution from gas. Moreover, each time a kWh of coal is replaced by wind, CO2 emissions from generating that kWh fall by 100%, whereas the drop when the coal-fired kWh is replaced by gas is only 40-65% (depending on whether the gas-fired kWh comes from a traditional steam-cycle generator or a newer combined-cycle generator). Nor do wind turbines entail mining “natural” gas and the consequent release of climate-destabilizing “fugitive” methane and black carbon. All told, the Breakthrough Institute’s dismissal of wind power as a factor in reducing CO2 from the U.S. electric power sector is both mistaken and incongruous.
Breakthrough Claim #5: Europe is “returning to coal-burning.”
To see if Europe is indeed “returning to coal,” I registered (at no charge) with Enerdata, authoritative compilers of country, region and world data on energy production and consumption. These data are from Enerdata’s table, “Coal and Lignite Domestic Consumption in Europe (millions of metric tons)”:

Rather than a return to coal, the data show a dip from 2007-08 to 2009, followed by a slight rise to 2011. Even if the 2011 rise has continued into 2012, it likely amounts to no more than a return to the level of 2007-08. In short, Europe’s coal consumption shows no clear trend.
Beakthrough Claim #3: No country cut greenhouse gas emissions more since 2007 or 2008 than the U.S.
True enough, if Breakthrough was measuring cuts in tons — after all, the U.S. is the World’s second largest CO2 emitter, with nearly triple the emissions of third-place India and fourth-place Russia. But not necessarily true on a percent basis.
Again referencing Enerdata, from 2007 to 2011, CO2 emissions from fossil-fuel combustion decreased by 7.4% in the U.S. and by slightly more, 8.5%, in the 33 countries that Enerdata collects as “Europe.” (See Enerdata table: CO2 emissions from fuel combustion (MtCO2).) While the relative positions of the U.S. and Europe may switch when the data are extended to 2012 (for declines in CO2, though not necessarily for other GHG’s associated with gas fracking), neither entity has a clear lead on the other.
We come now to the final point at issue, and, perhaps, the most central to the Carbon Tax Center’s dispute with the Breakthrough Institute:
Breakthrough Claim #4: Europe has a price on carbon.
It appears that a “price on carbon” is a rhetorical device wielded by the Breakthrough Institute to discredit carbon taxing. At the Carbon Tax Center, we’ve said all along that a carbon tax must be (i) robust (not minuscule), (ii) rising, and (iii) transparent. The “price on carbon” that Nordhaus and Shellenberger claim “Germany and other European countries have implemented through their cap-and-trade system” has been none of those three things, as this graphic shows.
The graph is by Dieter Helm, professor of energy policy at Oxford, and is from his recent presentation to the Bruegel Energy and Climate Exchange, “Climate change and EU policy — why has so little been achieved?” It shows the first seven years’ worth of CO2 futures prices under the European Union’s Emissions Trading System (EU ETS). The price has varied from 30 euros per ton of CO2 down to zero. As the graph shows, the price’s course over time more closely resembles a Mandelbrot fractal than a clear trajectory that would communicate to entrepreneurs and individuals the rewards from moving to low-carbon behaviors and innovations (and the penalties from maintaining the status quo).
Moreover, it’s not enough for emissions to simply decline, as they have in both Europe and the U.S., due in considerable part to the economic slowdown that has afflicted both. The declines in carbon emissions must be sustained and massive. The heart of the climate solution remains what it has always been: a steadily rising U.S. carbon tax with border tax adjustments that motivate China and other growing emitters to implement their own carbon taxes (else the U.S. will collect their carbon tax revenues via carbon-content tariffs).
A wildly fluctuating carbon price such as the one delivered by the EU ETS may be a handy rhetorical device for the Breakthrough Institute and other carbon tax opponents. But it in no way qualifies as meaningful and should not be wielded as a means to discredit genuine carbon taxing.

When NY Gov. Cuomo 'Got' Climate Change
Superstorm Sandy has made climate change believers of many, but none better-known than New York Governor Andrew Cuomo. “[C]limate change is a reality, extreme weather is a reality, it is a reality that we are vulnerable,” Cuomo told New Yorkers at a post-Sandy briefing on Wed. Oct. 31, a day and a half after the tidal surge from the storm inundated coastal communities and spread unprecedented devastation across hundreds of miles of shoreline — and far inland as well — in Long Island, New York City and neighboring New Jersey. Lost to flooding, wind and even fire are more than 100 lives, uncounted homes — I’m guessing well over 100,000 — and entire villages and towns. State officials are estimating that damage to the region will exceed $50 billion, today’s NY Times reports, making it the country’s costliest storm other than Hurricane Katrina, which wiped out much of New Orleans in 2005.
Cuomo’s words, while unremarkable to anyone conversant with the basics of climate science, were unprecedentedly frank not just for him but for any major U.S. office-holder. They were also unscripted, suggesting that the governor may have had a “conversion moment” in which old perceptions gave way to a new reality. If so, I’ll bet the trigger came on the evening when Sandy struck. That would have been when Cuomo came face-to-face with the massive power of the floods unleashed by the storm.
Here’s how that moment was described by the weekly New York Observer, in its blow-by-blow account of how top city and state officials fought to comprehend the storm’s destructive force:
Joe Lhota (Metropolitan Transportation Authority chief): When I got downtown to meet [NYC Transit head Tom] Prendergast, we were looking at where we were, we both realized how deep the water was at South Ferry station. It didn’t surprise me when we found out later that the water was all way up to the ceiling. It was four feet above the ground that night. And then we walked over to the Brooklyn-Battery Tunnel, where we ran into the governor totally by accident. I don’t know why I went over to the Brooklyn-Battery tunnel. I really don’t. We hadn’t been told about water rushing in, but we went over there, and boy, what I saw was extraordinary. White-water rapids, and a pace — you could have created hydro power.
I’ll use the words that the governor used. It was disorienting. It was. You heard it. You saw it. And you weren’t really sure you were hearing it and seeing it correctly. I never expected the Hudson River to do that.
Josh Vlasto (Cuomo administration communications director and senior adviser): The governor was standing with Lhota at the mouth of the Brooklyn-Battery Tunnel and the water was rushing in so quickly that the sound was deafening. I think that for him, that was the moment — where the water was that night, when you’re down there, standing at the tunnel, there’s so much water that you can’t hear — I think the governor would say that was the “We Got a Problem” moment.
Howard Glaser (Cuomo administration director of state operations): It was a sound you never heard before in Lower Manhattan, a rushing river. And then we went over to the World Trade Center and we saw Niagara Falls was pouring into the site.
Those aren’t quotes from the governor, of course, but they may as well be, given how tightly he stage-manages his administration’s utterances and given that Lhota, Vlasto and Glaser all serve at his pleasure.
Nearly halfway through his (first) term, Gov. Cuomo is arguably the state’s most powerful governor since Rockefeller and its most popular chief since FDR. He is already the subject of considerable speculation as a possible Democratic presidential candidate for 2016. At the same time, energy issues concerning renewables, nuclear power and especially fracking are an increasing presence on his state policy and political plate. Like other concerns, political attention to climate change will ebb and flow depending on public pressure and the flow of events. But if the governor indeed had a climate-change conversion moment along the lines I’m suggesting, that moment might just spark policies — incentives, regulations, and perhaps even a state carbon fee — that could turn New York State into a leader in arresting the buildup of carbon pollution in the state’s — and planet’s — atmosphere.
